Transported Cooled Semen Contract
This is an agreement wherein _____________________________(mare owner) has engaged Running Brook Quarter Horse Ranch (breeder and agent for the said stallion) for one service to the stallion KS Cash N Fame for the mare ________________________________ Reg. No._______________, for the 20___ breeding season for a fee of $1000.00 payable to Running Brook Quarter Horse Ranch.
This agreement is subject to the following terms and conditions:
1. A non-refundable booking fee of $250.00 is payable when the contract is signed and returned. This fee is applied to the total breeding fee. The balance of $750.00 is payable prior to the shipment of semen. 2. The first collection/shipment of semen is included in the total breeding fee. Mare owner incurs any/all additional collection/shipment charges with future shipments, if needed. 3. Mare owner is responsible for any deposit required on shipping container(s) with Running Brook Ranch. The semen container must be returned to Running Brook Ranch the day after the mare is inseminated. The mare owner will pay all costs of returning the container. 4. Running Brook Quarter Horse Ranch must be notified when the mare comes into heat by the mare owner or representative. 5. Running Brook Quarter Horse Ranch must be notified a minimum of 24 hours in advance of the date the semen needs to be shipped, 48 hours prior to mare owner’s receipt of the shipped semen. 6. Breeding season begins February 1and ends July 1 of each calendar year. 7. Should the stallion die, become unfit for breeding or be sold, the breeder’s liability is discharged fully by return of the service fee for inability to breed or rebreed with cooled semen. 8. Running Brook Quarter Horse Ranch offers a live foal guarantee. If the mare does not settle, produces a foal that is stillborn or unable to stand and nurse, the breeder is held harmless from all liability and the mare owner is entitled to a free return service the following year for a $250.00 collection/shipment fee. Stallion fees are not refundable unless paragraph (7) applies. 9. This contract is entered into in the State of California, in the county of Glenn, and will interpreted and enforced under the laws of that state. 10. Should either party breach this contract, the breaching party shall pay all court costs and attorney fees of the other party related to such breach. 11. This contract represents the entire agreement between the parties. No other agreements, verbal, written, or implied are included unless specifically written in this contract. When mare owner and Running Brook Quarter Horse Ranch (breeder) sign this contract it will then be binding on both parties, subject to the above terms and conditions.
